These Terms of Service govern the use of the website solfusion.pl and the provision of electronic services within the meaning of the Polish Act of 18 July 2002 on the provision of electronic services. The official, legally binding version is the Polish version; this English translation is provided for convenience.
§1. Definitions
- Service Provider — Solfusion Group Polska sp. z o.o., Aleja Grunwaldzka 56 / 113, 80-241 Gdańsk, Poland; KRS 0001053788, NIP 9571162203, REGON 526162899.
- Website — solfusion.pl and its subpages.
- User — any natural person, legal entity or organisational unit using the Website.
- Services — electronic services provided through the Website: contact form, AI Energy Auditor, Solfusion AI chat assistant, presentation of offers.
§2. General provisions
- These Terms govern the use of the Website and the rights and obligations of Users and the Service Provider.
- Use of the Website is voluntary and free of charge.
- The Terms are accepted by starting to use the Website or by sending an inquiry via the contact form.
- The Service Provider offers energy optimisation services: PV design and installation, battery storage (BESS), reactive power compensation, and partner-based electricity trading.
§3. Technical requirements
- Use of the Website requires:
- a device with Internet access,
- a browser supporting HTML5, CSS3 and JavaScript (Chrome 100+, Firefox 100+, Safari 15+, Edge 100+),
- cookies enabled for full functionality.
- The hero animation uses WebGL 2.0. Lack of WebGL support does not impair other functions.
§4. Scope of Services
- Informational content about the Service Provider's offer.
- Contact form for inquiries.
- AI Energy Auditor — a tool providing a preliminary, non-binding analysis of PV/BESS potential based on parameters supplied by the User. Results are indicative and do not constitute an offer within the meaning of Art. 66 §1 of the Polish Civil Code.
- Solfusion AI — a chat assistant providing general information about energy optimisation. Responses are informational and may contain errors. Binding quotes and advice require an individual audit.
§5. Contract formation
- Content presented on the Website, including AI Auditor results, does not constitute an offer under Art. 66 §1 of the Polish Civil Code, but an invitation to enter into a contract.
- A contract is concluded based on a separate document (commercial offer / contract) signed by both parties after an audit and 15-min load profile analysis.
- Consumers within the meaning of Art. 22¹ of the Polish Civil Code have the right to withdraw from a distance contract within 14 days under the Act of 30 May 2014 on consumer rights.
§6. User rights and obligations
- The User is required to use the Website in accordance with the law, good practice and these Terms.
- It is prohibited to:
- supply unlawful content,
- attempt to breach the Website's security, including DoS attacks, unauthorised access or unauthorised vulnerability scanning,
- mass-scrape content without the Service Provider's consent,
- use the AI chat to generate content infringing third-party rights or unlawful content.
- The User is responsible for the truthfulness and correctness of data provided.
§7. Liability of the Service Provider
- The Service Provider makes reasonable efforts to ensure continuous operation of the Website but does not guarantee 100% availability.
- AI Auditor results and Solfusion AI responses are indicative and informational. The Service Provider is not liable for business decisions made solely on their basis.
- The Service Provider is not liable for damages arising from:
- improper use of the Website by the User,
- force majeure,
- actions of third parties (including AI and infrastructure providers),
- provision of false or incomplete data by the User.
- Liability towards non-consumer Users is limited to actual damage, excluding lost profits (lucrum cessans), to the extent permitted by law.
§8. Complaints
- Complaints concerning the Services may be submitted:
- by e-mail to: dok@solfusion.pl,
- in writing to the Service Provider's registered office.
- A complaint should include: User details, problem description, date of occurrence, the User's request.
- The Service Provider reviews complaints within 14 days of receipt.
§9. Out-of-court dispute resolution
Consumers may use the EU Online Dispute Resolution platform: ec.europa.eu/consumers/odr.

§11. Intellectual property
- All rights to the Website, its content, graphics, layout, source code, and the "Solfusion" trademarks belong to the Service Provider or its licensors.
- Copying, modifying or distributing content without the Service Provider's consent is prohibited beyond personal fair use.
§12. Final provisions
- These Terms are effective from 26 May 2026.
- The Service Provider may amend these Terms. Users will be notified by publication of the new version on the Website with 14-day prior notice.
- Matters not regulated herein are governed by Polish law, in particular the Civil Code, the Act on the provision of electronic services, the Consumer Rights Act and the GDPR.
- The competent court for disputes is the court having jurisdiction over the Service Provider's registered office — for consumer disputes, jurisdiction follows the Polish Code of Civil Procedure.
